The property listed in this catalogue offered by Cain Modern is subject to the
following terms and conditions. Any of the following conditions of sale may be
amended, waived, or modified in the sole discretion of Cain Modern. By buying an
item whether online or in the sales room or by any other means, the buyer agrees
to be bound by the following conditions of sale:
All sales are final. Returns are subject to Cain Modern's approval, with a
25% restocking fee. All shipping charges are the responsibility of the
Cain Modern makes NO representations or warranties, express or implied, with
respect to the property or the correctness of the catalogue or other description
of the authenticity of authorship, physical condition, size, age, quality,
rarity, importance, provenance, exhibitions, literature or historical relevance
of the property or otherwise. No statement anywhere, whether oral or written,
shall be deemed such a guarantee, warranty, or representation of such item.
Requests for additional condition details will be
answered as the information becomes available and in the order that they are
received. Emailed condition inquiries will not be responded not later than 24
hours after received.
Any additional condition information obtained
will be added to item description when appropriate. If you prefer speaking to a
live person, condition reports may also be obtained by telephone. Feel free to
call us at 323.937.0326. The absence of a condition statement does not imply
that the item is free from wear and tear, imperfections, or the effects of
aging. All condition statements are opinion. Cain Modern will have no
responsibility for any items broken or destroyed by the shipping agencies and
all shipping and packaging materials must be saved to present to the shipping
agencies in case of a claim.
Shipping costs are not included in the purchase
price. Smaller objects and furniture can ship with a regular domestic carrier
(UPS, FedEx etc.), larger items will deliver via a trucking agent. A variety of
services are possible from blanket wrap to crating, as always fully insured. We
can assist in finding an agent, and you may also make your own arrangements.
If due to arrangements of your home it is
difficult to maneuver a piece of furniture in narrow halls, doorways,
stairwells, etc…we cannot be responsible for damage to the furniture, floors, or
walls. We cannot be held responsible if your order does not fit into your home.
You cannot refuse or return your order for this reason.
It is solely the responsibility of the customer
to transport returned merchandise to the store. We can arrange a delivery
service to pickup merchandise that needs to be returned or exchanged for an
additional fee which is paid directly to the delivery service
International shipping is NOT calculated at the check out page and even though
we ship anywhere in the World using different carriers or you can arrange your own carrier but please contact us if you need assistance with this matter.
